1.     These terms and conditions (“Terms”) are the rules which apply to BPI (British Recorded Music Industry) Limited’s (“BPI”) social media competitions (each a “Competition” and together the “Competitions”) offered by BPI unless otherwise expressly stated. 

 

2.     By entering a Competition, entrants agree to be bound by these Terms.

 

  1. The Competitions are organised by BPI whose registered address is Riverside Building, County Hall, Westminster Bridge Road, London SE1 7JA.

 

  1. Each Competition will open and close on the dates and times notified by BPI and the prize or prizes (as relevant) for each Competition (each a “Prize”) will be notified by BPI, in each case on the relevant social media platform for that Competition.

 

  1. BPI reserves the right to cancel or amend the Competitions or these Terms at any time without prior notice. A copy of the Terms may be obtained by sending a stamped addressed envelope to: “BPI Social Media Competitions”, Legal Department, BPI (British Recorded Music Industry) Limited, Riverside Building, County Hall, Westminster Bridge Road, London SE1 7JA.

 

  1. Entry is only open to residents of the United Kingdom who have a Twitter or Facebook account (as relevant for each Competition). Employees of BPI or its affiliates and/or agencies associated with the Competitions and members of their immediate families (including any live-in partner) are ineligible to enter.  Any such entries will be invalid.

 

  1. Prize winners may not sell or otherwise dispose of for any commercial or other monetary value any of the Prizes.

 

  1. Eligible entrants may enter the Competitions in the following ways:

 

  • if a Competition is posted on Twitter (which shall be at the sole discretion of BPI), any Twitter user may enter a Competition by following the @bpi_music Twitter account and retweeting the tweet about that Competition; and

 

  • if a Competition is posted on Facebook (which shall be at the sole discretion of BPI), any Facebook user may enter that Competition by clicking ‘Like’ on the BPI Facebook page and by clicking ‘Like’ on the post about that Competition.

 

  1. Each entrant may enter a Competition more than once, but each entrant shall only be eligible to win a maximum of one Prize per Competition.

 

  1. For the avoidance of doubt, entrants will only be eligible to win a Prize if they follow the @bpi_music Twitter account (if entering a Competition on Twitter) or ‘Like’ the BPI Facebook page (if entering a Competition on Facebook).

 

  1. There is no purchase requirement or fee to enter the Competition.

 

  1. Entries to a Competition must be made in the manner specified. Failure to do so will disqualify the entry.

 

  1. BPI and its group companies cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, viruses, bugs or other causes outside their control.

 

  1. Prize winner(s) for a Competition will be chosen at random from all qualifying entries for that Competition after 5.00pm on the day on which that Competition closes. The decision shall be final and no correspondence or discussion shall be entered into in relation to the same.

 

  1. The name of the Prize winner(s) for a Competition will be posted on BPI’s Twitter or Facebook account (depending on which platform was used to enter the Competition) on or around 6:00pm on the day on which the winner is chosen for that Competition.

 

  1. Prize winners shall be given instructions as to how to collect their Prize and BPI reserves the right to request identification from Prize winners before their Prize is given to them.   

 

  1. In the event that the Prize comprises event tickets, there may be additional terms and conditions but in any case, the Prize winner must be aged 18 or over to enter the Competition and must bring identification with them to obtain entry to the event and to identify their age. No alternative dates will be provided for the event and the Prize winner must arrange their own transport to and from the event and will be responsible for all other expenses, including food and drink. 

 

  1. In the event that BPI or its agent is reasonably unable to contact a Prize winner for whatever reason that Prize winner may be disqualified and an alternate winner may be selected.

 

  1. Claims for a Prize must be made within the time and in the manner notified to the Prize winner upon notification by BPI that they have won a Prize. Failure to claim the Prize within this time or in the manner specified may result in disqualification and selection of an alternate winner.

 

  1. Each Prize is non-transferable and there is no cash alternative. BPI reserves the right to substitute any Prize with an alternative at any time and shall notify entrants and/or Prize winners (as relevant) of the same.

 

  1. Each Prize is awarded at BPI’s discretion and no Prize shall be awarded in the event of improper actions by or on behalf of any entrant (in BPI’s sole discretion).

 

  1. BPI cannot accept any liability for any damage, loss, injury or disappointment suffered by any entrant entering the Competitions or as a result of accepting a Prize. BPI is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the internet, telephone lines or at any website, or any combination thereof, including any injury or damage to an entrant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in the Competitions.  Nothing shall exclude BPI’s liability for death or personal injury as a result of negligence.

 

  1. Each Prize winner may be asked to take part in promotional activity and BPI reserves the right to use the names and locations of that Prize winner, their photographs and audio and/or visual recordings of them in any publicity.

 

  1. Any personal data relating to entrants will be used solely in accordance with the Data Protection Act 1998 and in line with BPI’s privacy policy which can be found at: https://www.bpi.co.uk/privacypolicy.aspx

 

  1. These Terms shall be governed by English law and, in the event of any dispute, BPI and each entrant submit to the exclusive jurisdiction of the English courts.
